This Privacy Policy explains how BMTech Nexus LLC, the operator of MagicSky AI ("MagicSky AI," "we," "us," or "our"), collects, uses, shares, and protects personal information when you visit https://magicsky.ai/ or use our tools and services (the "Services"). • Account information: your name, email address, password (stored only in encrypted, hashed form), and profile photo.
• Content you submit: the prompts, images, files, and other materials you upload or enter.
• Support and contact information: the messages, attachments, and contact details you send us through the Contact page, our in-app support channels, or email.
• Payment information: when you make a purchase, our payment processors collect your payment details. We receive limited information such as your billing country, the items you bought, the amount, and the payment status. We do not store full card numbers.

Information created when you use the Services

• Generated content: the images, videos, music, lyrics, and other results the Services create for you, along with related details such as the tool used, settings, and creation time.
• Account activity: your credit balance and transactions, subscription status, likes, share links, and daily check-ins.

Information collected automatically

• Device and usage information: IP address, browser type, device type, operating system, language, pages viewed, features used, referring website, and the date and time of your visits.
• Approximate location: your country or region, inferred from your IP address.
• Marketing attribution: campaign parameters and ad click identifiers in the links you use to reach us (for example, UTM parameters or Google Ads click IDs).
• Free-trial protection: if you use the Services without an account, we use a device identifier and a hashed (non-reversible) version of your IP address to limit free trials and prevent abuse.
• Cookies and similar technologies: described in Section 5.

Information from third parties

• Sign-in providers: if you sign in with Google, we receive your name, email address, and profile photo from Google.
• Payment processors: confirmation of payments, refunds, and subscription status.

4. Your Content and AI Processing

To generate results, we send your prompts and uploaded files to third-party AI model providers, which process them on our behalf to return your Output. We store your submitted content and generated results so you can view, download, and share them in My Works.

We do not sell your content, and we do not use your content to train our own AI models. Content you choose to share through a share link can be viewed by anyone who has the link.

5. Cookies and Similar Technologies

We use cookies, local storage, and similar technologies for the following purposes:

• Essential: keeping you signed in, remembering your language, securing your account, and preventing abuse. These are necessary for the Services to work.
• Analytics: understanding how visitors use the Services, using tools such as PostHog and Google Analytics.
• Advertising measurement: measuring the results of our advertising, for example through Google Ads conversion tracking.

You can control or delete cookies in your browser settings. If you block essential cookies, some parts of the Services, such as signing in, may not work.

6. How We Share Information

We do not sell your personal information. We share personal information only as described below:

• Service providers that help us run the Services under contracts that limit their use of your information, including cloud hosting, databases and file storage, AI model providers, payment processors (such as Stripe, Dodo Payments, and PayPal), email delivery, analytics, and security and bot protection (such as Cloudflare).
• Legal and safety reasons: when required by law or legal process, or when we believe disclosure is necessary to protect the rights, property, or safety of our users, the public, or us.
• Business transfers: in connection with a merger, acquisition, financing, or sale of all or part of our business.
• With your consent or at your direction, including content you make public through share links.

We keep personal information for as long as needed to provide the Services and for the purposes described in this policy:

• Account information and your content are kept while your account is active and deleted or anonymized within a reasonable period after you ask us to delete your account.

California residents: California law gives you the right to know what personal information we collect, use, and disclose, to request deletion or correction, and to opt out of the sale or sharing of personal information. We do not sell personal information. You can make a request by emailing support@magicsky.ai, and you may use an authorized agent to make a request on your behalf.

10. International Data Transfers

We are based in the United States, and our service providers may process information in the United States and other countries. When we transfer personal information from the European Economic Area, the United Kingdom, or Switzerland, we use appropriate safeguards, such as standard contractual clauses.

The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, please contact us and we will delete it.
